Terms of Agreement

Thank you for using dPO!

 

These Terms of Agreement (“Terms”) are a binding legal agreement between you and dPO that governs your right to use the websites, applications, and other offerings from dPO (collectively, the “dPO”). When used in these Terms, “dPO,” “we,” “us,” or “our” refers to the dPO brand set out on (www.dpotechnologies.com) with whom you are contracting.

 

The dPO Platform offers an online venue that enables users (“User”) to publish, offer, search for, and purchase commercial property. Users who publish and offer properties are “Sellers” and Users who search for, purchase, or use services are “Buyers”. Sellers offer a (“Listing”). Upon creation of a verified account, Sellers will be given access to and use of many features on the dPO Platform. It is imperative that sellers keep account information as accurate as possible. As the provider of the dPO Platform, dPO does not own, control, offer, or manage any Listings. dPO is not a party to the contracts entered into directly between Buyers and Sellers, nor is dPO a real estate broker, real estate company, or insurer. dPO is not acting as an agent in any capacity for any User, except as specified in the separate Payments and Fees sections (“Payments and Fees”). We maintain other terms and policies that supplement these Terms like our Privacy Policy, which describes our collection and use of personal data, and our Payments Terms, which govern any payment services provided to Members by the dPO payment entities (collectively "dPO Payments").

 

If you are a Seller, you are responsible for understanding and complying with all laws, rules, regulations and contracts with third parties that apply to your Seller Services.

Buyer Terms

 

I. Our Mission

            It is dPO's primary mission to bring you the highest quality of service. In today’s fast-paced world, communication to the highest caliber is more pertinent than ever. Here, at dPO we hope to bridge the communication gap that exists in the realm of the logistics industry. Specifically, regarding educating drivers of 18-wheelers about their properly designated overnight locations.  

 

II. Searching and Purchasing on dPO

            When using dPO to peruse and/or purchase listings, and by providing your consent, you are also confirming that you have provided the most accurate and up-to-date information. Specifically, information that aligns with our mission as described above. Also, you can receive and review electronic records and have an active email address for use. This consent applies to your use of the dPO Mobile App and dPO Website application(s).

 

III. Cancellations, Reservation Issues, Refunds, and Purchase Modifications

            In the event that either you or dPO terminates, cancels, or suspends your transaction, you will no longer be able to continue with the current order on the dPO app or the dPO website. If you have any pending or saved transactions in any dPO cart linked to your dPO Account, please contact us in one of the following ways to discuss your options, including transferring any remaining funds to a new account.

IV. Your Responsibilities and Assumption of the Risk

            When you use the dPO Platform and Payment Services, we automatically collect personal and other information. This information may include:

 

            Geolocation Information. Such as precise or approximate location determined from your IP address, mobile or other device’s GPS, or other information you share with us, depending on your device settings. We may also collect this information when you’re not using the app if you enable this through your settings or device permissions.

 

            Usage Information. Such as the pages or content you view(ed), searches for Listings, listings you have saved, additional services you have added, and other actions on the dPO Platform.

 

            Log Data and Device Information. Such as details about how you’ve used the dPO Platform (including if you clicked on links to third-party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, and the pages you’ve viewed or engaged with before or after using the dPO application. We may collect this information even if you haven’t created a dPO account or logged in.

 

            Cookies and Similar Technologies as Described in Our Cookie Policy.

 

            Payment Transaction Information. Such as payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, PayPal email address, IBAN information, your address, and other related transaction details.

Seller Terms

 

V. Listing on dPO

            You can make certain information publicly visible to others, such as:

 

            Your public profile page, which includes your profile photo, first name (or initials where applicable), description, and city.

 

            Listing pages that include information such as the precise location description, calendar availability, profile photo, aggregated demand information (such as page views over a period), and additional information you choose to share.

 

            Reviews, ratings, and other public feedback.

 

            Content in a community or discussion forum, blog, or social media post.

 

            We may display parts of your public profile and other Content you make available to the public like Listing details on third-party sites, platforms, and apps.

Information you share publicly on the dPO Platform may be indexed through third-party search engines. In some cases, you may opt out of this feature in your account settings.

 

VI. Managing Your Listing

            You can access and update some of your personal information through your Account settings. If you connected your dPO to a third-party service, like Facebook or Google, you could change your settings and unlink from that service in your Account settings. You are responsible for keeping your personal information up to date.

 

VII. Cancellations, Property Issues, and Additional Property Concerns

            To help facilitate sales or other interactions between Members (who may be located in, or use service providers located in, jurisdictions with varying levels of property protection), we may share information in situations such as:

 

    Between Guest(s) and Host(s) when:

 

        A transaction cancellation request is made, when there is a dispute made by any co-owner, or a dispute is submitted, such as profile, name, names of any additional property owners, transaction history, review information, age of guest (unless prohibited by applicable law), dispute outcome (when applicable), and other information you choose to share and submit.

 

        A transaction is confirmed, and more information is shared to help coordinate the property sale, such as profile photo and phone number.

 

        You as a Property Owner have a confirmed listing, certain information is shared with the Buyer (and any additional vested parties they invite, if applicable) to coordinate the sale, such as your profile, full name, phone number, and Listing address.

 

        You communicate with buyer(s), such as your name, profile picture, and message content.

    Between Sellers when:

        You as a seller invite additional interested parties to a listing, certain information is shared with each additional Buyer, such as your name, travel dates, current property owner name, Listing details, Accommodation address, and other related information.

    Between Buyers when:

        You decline an invitation to buy with another Member, you authorize those other Member(s), such as co-partners, to access and update your information and Member Content, such as certain information like your full name, phone number, Listing address, calendar, Listing information, Listing photos, and email address.

            Applicable as defined by property tax codes in respective jurisdictions.

X. Content Concerns

            When it comes to posting content on the dPO platform, we ask that you respect both dPO and its content partners. Additionally, we ask that you respect the rights of other members who seek the same protection.

            In the event a claim is made concerning infringement of content, then dPO will conduct a thorough investigation into the matter, and rule accordingly.

            To dispute any claim, please follow the links provided under the “Contact Us” section.

XI. Subscriptions and Fees

            Membership Fees and access to Premium Services will be determined by user preference.

​

XII. dPO User Expectations

            dPO expects users to utilize the application for its intended function. Any deviation outside the scope of this will more than likely result in legal prosecution. Said conduct will be tried to the fullest extent under the jurisdiction in which the alleged infringement occurred.

XIII. User Termination, Suspension, and Other Punitive Procedures

            In the event a user’s account is terminated, they will be permitted to dispute the claim in order to regain access to the dPO platform. While user’s account in dispute is under “Pending” status, they will not be permitted access to any of the dPO platform’s functions.

            Once a dispute claim is resolved in favor of the adverse party, the user will be notified of immediate account reactivation.

            In the event that dispute is NOT resolved in favor of the adverse party, then user account and IP address will be permanently banned from the dPO database.

            In the event the user attempts to bypass this initial security measure by using fraudulent, or deceptive methods, then further legal action will more than likely be taken.

XIV. Dispute Resolution

            For proper dispute resolution procedures and protocols,  please follow the abovementioned practices.

XV. dPO’s Position

            dPO will maintain a neutral position. However, this position is subject to change once a thorough investigation has concluded. In that event, should dPO’s investigative board be needed further to conduct additional research, then a proper governing board will be assigned as needed.

XVI. Subscription Perks

            Subscription Perks will be determined based on the level of user engagement. I.e. for access to premium perks, a premium subscription is required. 

​

XVII. Warranties

            The warranty will be determined on a per-case basis.

            I.e. for any property owner that so chooses, they may opt-in for an outside warranty package of their choice.

​

XVIII. Limitation of Liability

            dPO maintains a limited liability when it comes to user’s warranty.

​

XIX. User Security Measures

            Users are expected to maintain the most up to technology, and version of the dPO application to get the full dPO experience.
